The Role of Regional Identity in National Politics

Regional identity enters French national politics through a narrow door: a délibération, an arrêté, a line of the DGF. The sentiment arrives; the mechanism decides. The trade-off should be stated at once. The more the State recognises territorial distinctiveness, the more it must measure it, and measurement manufactures its own conflict. The FPIC, a horizontal levy between intercommunalités, is contested today less on its arithmetic than on its geography. Read identity as folklore and you will miss every decision that matters. Read it as an operational variable and the machinery becomes legible.

By regional identity I mean something a filing system can hold: the conversion of a territorial claim — linguistic, historical, economic — into instruments the French State knows how to operate. The adjacent concepts deserve naming immediately. Libre administration, under article 72 of the Constitution. The statuts particuliers of Corse and of the collectivité européenne d’Alsace. The péréquation chain: FPIC, DGF, DSC, attribution de compensation. The contrôle de légalité, exercised by the préfet. The European funds that reach a conseil municipal with conditions attached. For a maire, a DGS or an agent territorial, none of this is decorative. Every national compromise on identity lands on a desk as a mandatory act, a budget line or an eligibility file. This article follows the landing, one mechanism at a time.

What identity is, in administrative terms

An identity claim reaches the State as one of three objects: a demand for a statute, a demand for money, or a demand for an exception. The Constitution answers through article 72, which guarantees libre administration and names the collectivités à statut particulier among the collectivités of the Republic. It answers as well through article 1er: the République is indivisible. The Conseil constitutionnel has enforced that limit on the vocabulary itself, censuring the notion of a Corsican people as a component of the French people (décision n° 91-290 DC, 9 mai 1991). Identity can be named, financed and taught. It cannot be sovereign.

The statutes show the lawful containers. Corse received its statut by the loi du 13 mai 1991, with an assemblée and competences of its own. Alsace received the collectivité européenne d’Alsace by the loi du 2 août 2019, in force on 1 January 2021, carrying the droit local and the régime local de sécurité sociale into a single institution. Overseas, the single collectivités followed the local referendums of 2010. Each container has a price. Asymmetric competences complicate the standard formulas, and every exception must be defended again in each loi de finances.

The constitutional revision of 2003 added another route: the droit à l’expérimentation under article 72-4. A territory can obtain, for a limited time and on a limited object, a derogation from the legislative rule. Identity movements that master this route obtain more than movements that master only the vocabulary.

The money: how territory becomes an account

FPIC: equalisation with a public map

The fonds de péréquation des ressources des intercommunalités et des communes is the newest and the most debated instrument. Article 59 of the loi de finances pour 2012 created it. The mechanism is one sentence: when the potentiel fiscal per habitant of a commune nouvelle or an intercommunalité exceeds the average, a progressive prélèvement is operated and redistributed within the département. The yield was 611 M€ in the first year (2012; DGCL, collections de statistiques). It reached about 1,03 Md€ by 2016, then evolved with the growth of the valeur ajoutée, which is the tax base it weights.

Identity enters here as geography. The contributive EPCI cluster around the coast: the Côte d’Azur, the Paris basin, the Alpine valleys. The redistributive EPCI cluster in the interior. Conseils communautaires in the contributive regions vote refusals that the fiscal administration does not register, because the prélèvement operates d’office. The Cour des comptes has long documented the complexity of this chain (see Les finances publiques locales, juillet 2022). The lesson is sobering. A mechanism that claims to be purely arithmetic still publishes, each year, a map of who pays for whom.

DGF, DSR, DSU: recognition without identity variables

The dotation globale de fonctionnement distributes about 27 Md€ to the communal block, frozen in value since 2013 (DGCL, Les finances des communes, édition 2023). Two of its parts carry the péréquation mandate. The dotation de solidarité rurale favours communes of small size and low potentiel financier. The dotation de solidarité urbaine favours communes with high social need, measured through the population of foreign origin, the logements sociaux and the low revenues of households. The formulas are national, annual and published. No variable measures language, history or attachment. A commune of the Pays Basque and a commune of the Beauce are treated by the same equations if their populations and potentiel financier match. The absence is a policy choice. It keeps the Republic indivisible on the expenditure side, at the cost of a recurring grievance: that the State counts everything except what the residents themselves say defines them.

The unintended consequence is the interesting part. Because the DGF cannot distinguish territories, the distinctiveness claims migrate to other channels. They migrate to the statuts. They migrate to Europe. They migrate, in some cases, to the préfet’s desk, in the form of acts that test the limit of the common rule.

DSC and attribution de compensation: identity inside the EPCI

The dotation de solidarité communautaire is the internal péréquation of the intercommunalité. It is frozen at about one billion euros (DGCL, Les finances des communes, édition 2023), which concentrates the politics. The attribution de compensation, in the same register, indemnifies each member commune for the fiscal resources transferred to the communauté; it is a dépense obligatoire; it perpetuates, year after year, the fiscal position of the commune on the day of its adhesion. In a territory such as the Pays Basque, where the intercommunalité covers the cultural area almost exactly, these two lines decide whether a small commune in Soule keeps a school, a trésorerie and a service public. The identity claim and the budget line meet without ever being named together in the deliberation. That is the point to retain. French administrative law handles distinctiveness best when it can write it as a figure.

On the map, the EPCI boundaries now matter more than the département lines for most services. An intercommunalité that matches a cultural area becomes a political actor. One that cuts across it becomes a grievance.

The préfet: national unity at the point of application

Since the loi du 2 mars 1982, the tutelle a priori is gone. What remains is the contrôle de légalité. The acts are transmitted without delay; the préfet has two months to déférer them to the tribunal administratif; silence operates as a decision not to déférer. In twenty years of signing arrêtés I have found that line stable. The préfet does not approve; he verifies. The distinction is the whole institution.

The police powers run on a parallel track. The maire holds the general police under article L. 2212-2 of the CGCT, for the bon ordre, la sûreté and the salubrité. The préfet holds the police spéciale on his own list of competences, and can substitute himself under article L. 2215-1 when the maire defaults. Identity claims surface here in concrete form: a manifestation, a plaque in two languages on a mairie, a street name in basque, breton or catalan. The arrêté is a unilateral act. It is deferrable. The tribunal administratif will judge it against article 2 of the Constitution and against the law of 4 août 1994, which protects the French language and leaves to the Conseil d’État the list of exceptions for regional languages.

Finance holds the same line. A budget adopted in déséquilibre is set by the préfet after avis of the chambre régionale des comptes (CGCT, art. L. 1612-12), and the ordonnateur answers for the compte administratif that the CRC examines. The préfet does not negotiate identity. He registers its costs, its acts and its conflicts, and refers the hard cases to the judge. A practitioner should also recall that the deferrable act is the commune’s own shield: a délibération annulled after a déféré cannot be attacked again for years by a private claimant on the same ground, because the judge has spoken.

Europe lands in the délibération

Structural funds: identity as an eligibility file

The structural funds reach a commune through the programme documents of the région, which is the managing authority for the FEDER and the FSE+. The France envelope for cohesion policy runs to about 18,4 Md€ for 2021-2027 (Commission européenne, fiche pays, 2021). A territory that can qualify as a transition region or as a lagging area gains access to co-financing rates that no domestic budget line offers. The eligibility files ask for indicators, partnerships and strategies. They do not ask for a people. But a cultural area that already has an institution — a communauté d’agglomération, a pays, a PNR — writes those strategies faster than a territory that must invent its perimeter first. The fonds européen agricole pour le développement rural, through the LEADER programmes, finances the same logic at a smaller scale: a local action group, a strategy, a budget (see la page de la Commission sur la cohésion).

The consequence cuts both ways. Europe pays for museums, trails, festivals and the valorisation of heritage, which are the presentable face of identity. Europe also imposes publicité européenne, state aid rules and contrôle de gestion, which are the presentable face of accounting. The commune that embraces the first accepts the second. There is no à la carte.

Procurement: the lawful channels of local preference

Public procurement is where identity tries to spend itself, and where the law says no with precision. The ordonnance of 23 July 2015 transposed directive 2014/24/UE. The code de la commande publique restated the ensemble, in force on 1 April 2020. Article L. 2112-1 sets the principles: liberté d’accès, égalité de traitement, transparence. A purely geographic criterion does not survive them. The Court of Justice fixed the rule in Concordia Bus Finland (24 January 2002, C-513/99): an award criterion must relate to the object of the contract.

What remains lawful is narrower than most elected officials believe. Award criteria may take account of social or environmental considerations (CCP, art. R. 2152-7), provided they are linked to the contract and announced in the règlement de consultation. Marchés réservés to établissements et services d’aide par le travail and to entreprises adaptées open a real channel for local insertion. A criteria such as short food circuits can be defended for a school canteen, because the object of the contract is the meal. A criterion that simply says “local supplier” will be censured. The identity-driven purchase order must become a functional specification before it becomes a legal act.

Fonction publique territoriale: identity through personnel

The statute of 26 January 1984 organises the fonction publique territoriale. Cadres d’emplois are defined nationally; recruitment is local; the paritarisme runs through the centres de gestion. A territoire that wants its language spoken in its crèches and its écoles de musique does not legislate; it recruits, and it signs chartes of engagement. The DGS applies the charte. The budget line carries the cost. The contrôleur de gestion reports the variance. This is how a cultural claim becomes an operating budget without ever being named in a law.

The constraint sits in the statute itself. National guarantees, concours and lists limit what a commune can invent in its own house. The room for manoeuvre is real but bounded, and it is bounded precisely where the identity demand would like it widest.

Case files: how the machinery answers

Alsace. The consultation of April 2013 — participation about 46 % (préfectures du Bas-Rhin et du Haut-Rhin, 2013) — produced a short majority for a single collectivité, which Paris first declined to register. The collectivité européenne d’Alsace arrived only on 1 January 2021. Eight years elapsed between the vote and the institution. The lesson is administrative, not sentimental: the vote names a preference; the loi de finances, the décret and the arrêté build the container.

Corse. The statut of 13 May 1991 was consolidated by ordinary instruments — continuité territoriale, transport, planning — more than by further statutes. The referendum of 6 July 2003 was carried nationally by a fraction of a point and rejected in Corse itself (ministère de l’Intérieur, 2003). Identity advanced afterwards through budgets and programmes, which is to say: through what a préfet can sign and a CRC can audit.

Pays Basque. The communauté d’agglomération du Pays Basque, created on 1 January 2017, gathers 158 communes and about 310 000 inhabitants (INSEE, populations légales 2021). Its perimeter matches the cultural area almost exactly, which makes it the natural interlocutor for the programmes européens and the natural frame for a cohésion politique that the communes could not have produced alone.

Occitanie. The région renamed itself in 2016, and the change was formalised by décret. The identity claim here is a marketing and territorial-marketing object; the administrative fact underneath is unchanged: the loi du 16 janvier 2015 cut the régions from 22 to 13 on 1 January 2016, and the competences of the new regions were set by the loi NOTRe of 7 August 2015. Names move faster than statutes.

One fact sums up the whole chain. The Conseil constitutionnel, on 20 mai 2021 (décision n° 2021-918 DC), censored the provision of the loi relative au patrimoine that would have authorised immersive teaching in regional languages. The reasoning was article 2 of the Constitution. The State can finance a language; it cannot displace the language of the Republic.

What a practitioner should retain

  • Identity is decided in the session, not in the street. The délibération, the arrêté and the budget line are the acts that count.
  • Follow the money first: FPIC, DGF, DSC and the attribution de compensation answer most of the questions the discourse raises.
  • The préfet is a register, not a censor: contrôle de légalité, déféré, budget-setting under article L. 1612-12 of the CGCT — the rest belongs to the tribunal administratif and to the Cour des comptes.
  • Europe pays for heritage and imposes accounting; procurement law blocks raw local preference; the fonction publique territoriale absorbs the rest through recruitment.

FAQ

Does French law recognise regional identities?

It recognises territories, not peoples. Article 72 of the Constitution names the collectivités à statut particulier, and the lois of 13 May 1991 for Corse and 2 August 2019 for the collectivité européenne d’Alsace build the containers. The Conseil constitutionnel censored the notion of a Corsican people as a component of the French people (décision n° 91-290 DC, 9 mai 1991). Can a commune favour local suppliers in public procurement?

A geographic criterion as such is unlawful, because it violates the liberté d’accès and the égalité de traitement (code de la commande publique, art. L. 2112-1). Award criteria must relate to the object of the contract (Concordia Bus Finland, 24 January 2002, C-513/99). Lawful channels exist: social clauses under article R. 2152-7, marchés réservés to ESAT and entreprises adaptées, functional specifications such as short food circuits for a canteen.

Can a maire install bilingual signage on the mairie?

The arrêté is a unilateral administrative act, transmitted to the préfet and deferrable to the tribunal administratif. The judge applies article 2 of the Constitution and the loi du 4 août 1994, which allows the languages of France alongside French within limits fixed by the Conseil d’État. The pattern holds across every case file. Identity in France is not a right recognised and then administered; it is a set of claims administered and thereby contained. The statuts are the containers. The dotations are the currency. The préfet is the register. The tribunal administratif is the boundary. A demand that cannot be written as a délibération, a budget line or an eligibility file will remain a demand, which is, in a Republic that governs by acts, the same as saying it will remain a protest.
